1. Acceptance of Terms

By accessing or using XPost ("the Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service. XPost reserves the right to modify these Terms at any time. Continued use of the Service following any changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to use this Service. By creating an account or using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. XPost reserves the right to request verification of age at any time and to terminate accounts that do not meet this requirement.

3. Nature of the Service

XPost is an online platform that allows users to browse dating profiles and connect with third-party dating services. XPost does not guarantee any specific outcomes, matches, relationships, or interactions. Profiles displayed on the platform may include AI-generated content, including but not limited to profile images and biographical text. XPost serves as a referral and discovery platform and is not itself a dating service.

4. Account Registration

To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify XPost immediately of any unauthorized use of your account.

5. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Harass, abuse, threaten, or intimidate other users or any person associated with the Service
  • Upload, transmit, or distribute any content that is illegal, harmful, defamatory, obscene, or otherwise objectionable
  • Attempt to gain unauthorized access to the Service, other accounts, or any related systems or networks
  • Use automated means (bots, scrapers, crawlers) to access the Service without prior written consent
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Use the Service to solicit, advertise, or promote commercial products or services without authorization

6. Third-Party Services

XPost may redirect or refer you to third-party websites, applications, or services ("Third-Party Services"). These Third-Party Services are not under the control of XPost, and XPost is not responsible for their content, policies, practices, or availability. Your use of any Third-Party Service is subject to that service's own terms and conditions and privacy policy. XPost makes no representations or warranties regarding any Third-Party Service and shall not be liable for any damages arising from your use thereof.

7. AI-Generated Content

The Service may display content that has been generated or enhanced using artificial intelligence technologies, including but not limited to profile images, biographical descriptions, and other media. Such content is provided for entertainment and illustrative purposes. XPost does not represent that AI-generated profiles correspond to real individuals. Users acknowledge and accept the presence of AI-generated content as part of the Service experience.

8. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, images, audio, video, software, and the overall design and layout, are the exclusive property of XPost or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Service without prior written permission from XPost.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection, use, and sharing of your information as described in the Privacy Policy. XPost takes reasonable measures to protect your personal information but cannot guarantee absolute security.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. XPOST DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. XPOST MAKES NO WARRANTIES OR REPRESENTATIONS REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT ON THE SERVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, XPOST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF XPOST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL XPOST'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO XPOST, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless XPost and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or proprietary right; or (d) any claim that your use of the Service caused damage to a third party.

13. Termination

XPost reserves the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Los Angeles County, California, and the parties irrevocably consent to the personal jurisdiction and venue therein.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

16. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or agreements published by XPost on the Service, constitute the entire agreement between you and XPost concerning the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and XPost.
